2. Scope

These Terms & Conditions apply to all purchases, commissions, services and agreements concluded through the online shop, email correspondence, quotations, invoices, direct studio sales or custom project agreements.

Conflicting customer terms shall not apply unless expressly agreed in writing.

 

3. Artistic & Handmade Nature of the Objects

Studio Milena Kling creates collectible glass objects, sculptures, lighting and functional design objects using artisanal and experimental production methods.

Works may be mouth-blown, hand-finished, silvered, sculptural, edition-based or one-of-a-kind.

Natural variations are an intentional part of the artistic process and do not constitute defects. Variations may occur in dimensions, shape, proportions, color depth, texture, optical distortion, reflective quality, bubbles, silvering, surface finish and weight.

Images on the website, in catalogues or press materials serve as references only. No two handmade objects are identical.

 

4. Product Availability

Availability displayed online is subject to change. Objects may already be reserved, exhibited externally, available only by commission or discontinued without notice.

Studio Milena Kling reserves the right to modify collections, editions, dimensions, finishes, pricing and technical specifications at any time.

 

5. Orders & Contract Formation

Orders become binding only after written confirmation by Studio Milena Kling.

For made-to-order works or commissions:

  • production begins only after receipt of payment or agreed deposit

  • timelines are estimated and non-binding unless expressly confirmed otherwise

Studio Milena Kling reserves the right to refuse orders at its discretion.

 

6. Pricing & Taxes

All prices are stated in Euro unless otherwise specified and may be shown excluding or including VAT.

International customers are responsible for import duties, customs charges, local taxes, handling fees and compliance with local import regulations.

 

7. Payment Terms

Unless otherwise agreed:

  • invoices are payable immediately

  • full payment is required before shipment or production

  • staged payments may apply for commissions or larger projects

Production timelines may shift in case of delayed payment.

Ownership of all goods remains with Studio Milena Kling until full payment has been received.

 

8. Production & Lead Times

Estimated lead times are indicative only.

Delays may occur due to artisanal production processes, kiln schedules, material sourcing, production breakage, transportation delays, customs procedures or force majeure events.

Studio Milena Kling shall not be liable for reasonable delays associated with handcrafted production.

 

9. Shipping & Risk Transfer

Shipping costs are charged separately unless otherwise agreed.

Risk transfers to the buyer upon handover to the shipping provider, except where mandatory consumer law states otherwise.

The buyer is responsible for customs clearance, import taxes and local compliance requirements.

Visible transport damage must be:

  • documented with the carrier

  • photographed

  • reported within 48 hours to both the carrier and Studio Milena Kling

Failure to do so may affect insurance claims.

 

10. Installation & Safety

Glass objects, lighting and wall-mounted works must be installed carefully and professionally.

Studio Milena Kling assumes no liability for damages resulting from improper installation, unsuitable mounting systems, electrical modifications, misuse, accidents after delivery or improper handling.

Any installation hardware provided by the studio must be independently assessed by qualified professionals prior to installation.

Electrical installations must comply with local regulations and be carried out by certified specialists.

 

11. Care & Material Characteristics

Glass is a fragile material and requires careful handling.

Minor traces of craftsmanship, asymmetry, irregularities and material expressions are part of the artistic character of the work.

Damage caused by impact, thermal shock, incorrect cleaning, outdoor exposure, improper storage, accidents or misuse is excluded from warranty.

 

12. Right of Withdrawal & Returns

Consumers within the European Union may have statutory withdrawal rights.

The right of withdrawal does not apply to commissioned works, custom-made objects, personalized pieces, made-to-order productions or specially fabricated editions.

Returns are accepted only if:

  • authorized in advance

  • unused

  • returned in original packaging

  • fully insured during transport

The buyer bears return shipping costs unless mandatory law provides otherwise.

Damaged or incomplete returns may be partially refunded or refused.

 

13. Trade, Interior & Professional Clients

Professional discounts, wholesale pricing and trade conditions are confidential and granted individually.

Trade clients are responsible for verifying suitability for hospitality projects, commercial installations, architectural applications and public environments.

Variations inherent to handcrafted production are accepted within reasonable artistic tolerance.

 

14. Intellectual Property

All content created by Studio Milena Kling including object designs, sculptures, photographs, renderings, texts, catalogues, visual concepts and website content remains protected by copyright and intellectual property laws.

No material may be reproduced, distributed, modified or commercially used without prior written permission.

 

15. Press & Editorial Use

Press images may be used exclusively for editorial purposes relating to Studio Milena Kling.

Usage requires proper crediting, preservation of copyright notices and no unauthorized modification, resale or redistribution.

Copyright remains with Studio Milena Kling and/or the respective photographers.

 

16. Limitation of Liability

Studio Milena Kling shall only be liable for intentional misconduct, gross negligence, injury to life, body or health and mandatory liability under German law.

Liability for indirect, incidental or consequential damages is excluded to the fullest extent permitted by law.

 

17. Force Majeure

Studio Milena Kling shall not be liable for delays or failure to perform caused by circumstances beyond reasonable control including natural disasters, pandemics, labor disputes, transport interruptions, governmental restrictions, supplier failures or energy shortages.

 

18. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of the Federal Republic of Germany.

For merchants and professional entities, the place of jurisdiction shall be Berlin, Germany.

Mandatory consumer protection laws remain unaffected.

 

19. Severability Clause

If any provision of these Terms & Conditions is found invalid or unenforceable, the remaining provisions shall remain unaffected.

 

Commission & Custom Production Policy

1. Scope

This policy applies to commissioned works, bespoke objects, custom dimensions, custom colors, project-based productions, interior and hospitality projects as well as individually adapted editions.

 

2. Artistic Interpretation

All commissioned works are created within the artistic language and production methods of Studio Milena Kling.

Natural artistic interpretation remains part of the creative process. Minor variations in shape, tone, reflection, texture, dimensions, silvering and proportions do not constitute defects.

 

3. Quotations & Deposits

Quotations are valid only for the specified period.

Unless otherwise agreed:

  • a deposit is required before production begins

  • deposits are non-refundable once production has started

  • materials, labor and kiln capacity are reserved specifically for the project

 

4. Production Process

Production timelines are estimates only.

Glass production involves technical risks including breakage, cracking, color variation, silvering irregularities and cooling failures.

Studio Milena Kling reserves the right to make technical adjustments necessary for production stability or artistic integrity.

 

5. Client Approvals

Where applicable, drawings, renderings, finishes or samples may be approved by the client before production.

Once approved, later changes may incur additional costs and extended timelines.

 

6. Cancellation Policy

Custom and commissioned works cannot be cancelled once production has begun.

If a project is cancelled after work has commenced:

  • deposits remain non-refundable

  • completed work and incurred production costs become payable

 

7. Shipping & Installation

Shipping, customs handling, insurance and installation are charged separately unless otherwise agreed.

The client is responsible for site suitability, structural conditions, electrical compliance, access requirements and local installation regulations.

Installation must be carried out by qualified professionals.

 

8. Storage & Collection

Completed works must be collected or shipped within the agreed timeframe.

Studio Milena Kling reserves the right to charge storage fees for delayed collection.

 

9. Photography & Documentation

Studio Milena Kling reserves the right to photograph commissioned works for portfolio use, exhibitions, press, archives, website and social media documentation unless otherwise agreed in writing.

 

10. Governing Law

This agreement is governed by the laws of the Federal Republic of Germany.

Jurisdiction, where legally permissible, shall be Berlin, Germany.
